Fault or no fault…an interesting proposal
My husband and I worked with engaged couples for 20 years at our church in marriage preparation. The last thing that we
ever wanted to see was one of our couples filing for a divorce. That just might get harder to do in Texas. Doing away with no fault divorce is what Texas State Representative Matt Krause from Ft. Worth has proposed in HB 93. It would remove insupportability, meaning “no fault,” as a grounds for divorce. Currently, couples in Texas can get divorced through the no-fault option without having to select one of the six categories of fault-based divorce (adultery, abandonment, cruelty, felony conviction, living apart for at least three years, or confinement to a mental hospital). Rep. Krause has filed a separate bill to extend the waiting period for divorce from 60 days to 180 days in cases where the family includes a child under 18 years of age, a child still in high school, or an adult disabled child living in the household.
Three out of every seven marriages in Texas end in divorce reports the Centers for Disease Control. Would HB 93 make a difference?
